These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "you") and BlazingBlue Hosting ("BlazingBlue," "we," "us," or "our") governing your access to and use of all services, websites, control panels, and related infrastructure operated by BlazingBlue Hosting.
By registering an account, completing a purchase, or otherwise accessing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies referenced herein. Your continued use of our services following any modification of these Terms constitutes acceptance of the revised Terms.
BlazingBlue Hosting provides game server hosting services on privately owned hardware. Servers are physically located in Seattle, WA, USA. Services are provided on a best-effort basis, and while we strive for maximum availability, BlazingBlue Hosting does not guarantee 100% uptime.

BlazingBlue Hosting does not provide a formal Service Level Agreement (SLA). Uptime, latency, and performance may vary depending on hardware conditions, ISP routing, and external factors outside of our control.

By registering, you represent and warrant that you meet all eligibility requirements. BlazingBlue Hosting reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
You are responsible for maintaining the confidentiality of your account credentials, including your email address, password, and any two-factor authentication codes. You agree to notify BlazingBlue Hosting immediately of any unauthorized use of your account.
BlazingBlue Hosting will not be liable for any loss or damage arising from your failure to protect your account credentials. All activities conducted under your account are your sole responsibility, regardless of whether you authorized those actions.
You may not share, sell, transfer, or otherwise grant access to your account to any third party without prior written approval from BlazingBlue Hosting.
Users are provided access to a control panel that may include server start, stop, and restart controls, console and command access, player management tools including whitelists, bans, and operator assignment, log viewing, and limited configuration options such as Java version selection and auto-start settings.
You are solely responsible for all actions taken through the control panel, server console, and in-game commands. The following actions are expressly prohibited without prior written approval via support ticket:
⚠️ If server configuration or data is deleted or damaged due to user action, BlazingBlue Hosting is not obligated to perform recovery. Recovery requests may be submitted via support ticket but are not guaranteed. Unauthorized modification of system-level settings may result in immediate revocation of service, loss of server data, and account suspension.
BlazingBlue Hosting performs automated backups on a best-effort basis. Backups are retained for approximately 7 days where available. However, backups are not guaranteed and should not be relied upon as your sole means of data preservation.
You are solely responsible for downloading and maintaining your own copies of important server data. BlazingBlue Hosting shall not be held liable for data loss resulting from:
Services are billed on a recurring monthly subscription basis processed through Stripe. By subscribing, you authorize BlazingBlue Hosting to charge your payment method on a recurring basis until the subscription is cancelled.
Refund Policy: Refunds are not provided once a billing period has commenced. This includes partial-month refunds for unused time following cancellation. Exceptions are made solely at the discretion of BlazingBlue Hosting and are not guaranteed.
Failure to pay invoices may result in:
BlazingBlue Hosting reserves the right to modify pricing at any time. Existing subscribers will be notified of price changes prior to the next billing cycle. Continued use of the service following a price change constitutes acceptance of the new pricing.
BlazingBlue Hosting reserves the right to suspend or terminate any account, with or without notice, for reasons including but not limited to:
Upon termination, access to services will be revoked immediately. Suspended accounts may have their server data retained for a limited grace period before permanent deletion. BlazingBlue Hosting is not responsible for any data loss resulting from account termination.
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. Server data may be retained for a short period following cancellation before deletion.
Servers are provisioned automatically following successful payment. Customers may be assigned a subdomain under blazingblue.org (e.g., servername.blazingblue.org) as a convenience feature.

Changes to routing infrastructure, hosting nodes, or network architecture may require updates to server connection addresses. Customers are responsible for updating any shared connection information if such changes occur. Display names or aliases shown in the control panel may differ from actual connection addresses.
Use of BlazingBlue Hosting services for any of the following purposes is strictly prohibited:
Violations of this policy may result in immediate suspension or permanent termination of service without refund, and may be reported to appropriate law enforcement authorities where required.
Each server is allocated a defined amount of RAM, disk storage, and CPU resources based on the purchased plan. Servers that consistently exceed reasonable CPU usage, consume excessive disk space beyond their allocation, or otherwise negatively impact platform stability may be throttled, migrated to a different node, or suspended.
Customers are responsible for the optimization of mods, plugins, datapacks, and server configurations. BlazingBlue Hosting does not guarantee compatibility with all third-party software, and performance issues caused by customer-installed content are the customer's responsibility.
BlazingBlue Hosting collects the minimum personal information necessary to provide services, including your name, email address, and billing information processed through Stripe. We do not sell, rent, or share your personal information with third parties for marketing purposes.
Customer data collected and stored includes:
Customers retain ownership of their server data. However, BlazingBlue Hosting reserves the right to access, inspect, or remove data in cases of non-payment, policy violations, account inactivity, or service termination. Data retained after account deletion is kept solely for billing and legal compliance purposes and is not used for any other purpose.
Payment processing is handled exclusively by Stripe. BlazingBlue Hosting does not store or have access to full payment card details.
By creating an account, you consent to receive transactional and service-related email communications from BlazingBlue Hosting, including:
Failure to receive emails due to spam filters, incorrect email addresses, or third-party mail provider issues does not exempt the customer from their service obligations or from the consequences of missed notifications.
To the maximum extent permitted by applicable law, BlazingBlue Hosting shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of, or inability to use, our services. This includes but is not limited to:
In all cases, BlazingBlue Hosting's total aggregate liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you to BlazingBlue Hosting in the thirty (30) days immediately preceding the event giving rise to the claim.
BlazingBlue Hosting reserves the right to modify these Terms of Service at any time. When material changes are made, we will make reasonable efforts to notify customers via Discord, email, or the hosting panel prior to the changes taking effect.
Your continued use of BlazingBlue Hosting services following the posting of updated Terms constitutes your acceptance of those changes. If you do not agree to updated Terms, you must cancel your service before the next billing cycle.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.
